Torsij Motorsports is registered with the Chamber of Commerce in Rotterdam under registration number 59596481. The VAT number of Torsij Motorsports is NL001349851B82. Although the texts, photos, images, descriptions, and prices in our catalog and website, as well as on other data carriers, are compiled with the utmost care, no rights can be derived from them.
Torsij Motorsports can never be held responsible or liable for any damage, injury, or loss, either direct or indirect, resulting from the information provided as described above or from the (improper, incorrect, or inappropriate) use of any product sold and delivered by Torsij Motorsports.
Applicability:
Our General Terms and Conditions apply to all transactions, including but not limited to: sale, rental, leasing, and loan of all products supplied by Torsij Motorsports.
Delivery Terms:
All deliveries are subject to retention of title. This means that all products supplied by us remain our property until the invoice has been fully paid. Retention of title does not relieve you of your payment obligations in any case.
Payment Terms: All customers must pay before delivery or immediately upon collection, using one of the payment methods accepted by Torsij Motorsports unless otherwise agreed. If Torsij Motorsports allows delivery before payment, a payment term of 7 days after delivery of the order applies.
Prices:
All prices listed on the website are shown including VAT and excluding shipping costs. Typographical and calculation errors are reserved. If an item is incorrectly priced, Torsij Motorsports reserves the right to cancel the delivery and refund any payments made.
Payment Deadline:
If the agreed payment term is exceeded, collection actions can be initiated without further notice, and all costs, including statutory interest and other fees, will be at your expense.
Shipping Costs:
Shipping costs are tiered based on the country and order size and are published on the “shipping costs” page.
Delivery:
Our goal is to ship all orders in stock that we receive with payment before 03:00 PM within 3 days, due to multiple storage warehouses. You will receive a tracking number from our carrier to track your delivery.
If, unexpectedly, part of your order cannot be delivered immediately, we will contact you. Orders are generally not delivered in parts unless otherwise agreed.
If the delivery time exceeds 30 days, you have the right to cancel your order at any time. Any amounts already paid will be refunded promptly (within 5 working days).
Purchase Obligation: All orders are binding and require purchase once the offer has been accepted, whether written or oral. When you click the “submit order” button on the last page of the checkout process, it means you have placed a “binding order with payment obligation” and are obligated to pay for and accept the products ordered.
Damage and Shortage Reports:
Reports of damage or shortages must be made to us within 2 working days after receipt of the goods. Upon receipt of deliveries, all packages must be checked for damage. If damage to the packaging is observed, it must be reported to the carrier. This damage must also be reported to us immediately.
If no damage is visible upon receipt but damage is found when unpacking, it must be reported to us immediately, preferably with photos of the damaged items. If items are missing, this must also be reported to us.
Returns:
If the order was placed exclusively through electronic communication (online store without personal and/or telephone contact), the customer has the right to return items within fourteen days after receiving the order, without providing any reason, and without incurring any penalty or cost.
However, the customer must always contact us before returning an item. Together, we will determine the best way to return the item.
If the return is not due to discrepancies between the ordered and delivered product, the shipping costs for returning the item will not be refunded. The shipping costs paid for your order will be refunded proportionally to the value of the returned item if the return does not concern the entire order.
If the return is due to a discrepancy between the ordered and delivered item or damage, the return shipping and re-delivery costs will be covered by us.
Custom-made products and products that are highly perishable are excluded from the right of return.
Items must be returned in their original, undamaged, and unopened packaging. Items delivered in a closed and/or sealed package cannot be returned if the seal or packaging has been broken and/or opened.
If the right of return is exercised, we will ensure a refund within 5 working days after receiving the returned item.
If a payment method incurs costs for us (credit card/PayPal) that we cannot recover, these will be deducted from the refund.
Minimum Order Size: There is no minimum order or order size per transaction.
Privacy:
All information provided to us will only be used for processing, administering, and delivering your order(s). Your data will be stored securely on the website and in our administrative software for an indefinite period. You can view and edit the personal data we have stored in your account.
Torsij Motorsports will never share your data with third parties, except for carriers for whom data is necessary for delivery.
If you wish to delete your account, you can notify us, and we will remove your data from our systems, except from the administrative software, where deletion is not possible.
You can subscribe to our newsletter through the website or during account creation. If you no longer wish to receive it, you can unsubscribe via the link in the newsletter after receiving it.
Applicable Law:
Disputes will be resolved as much as possible through mutual consultation. If that is not possible, the Dutch courts will have jurisdiction, and the court in the district where Torsij Motorsports is located will have authority, unless Torsij Motorsports chooses the court in your place of residence or establishment.
